Laws Pertaining to Teenagers

DRIVER’S LICENSE SUSPENSION:  
PERSONS CONVICTED OF CONTROLLED SUBSTANCE OFFENSES

The DMV must immediately suspend or delay the driver’s license of any person for six months upon receipt of a court abstract showing that the person has been convicted of any specified controlled substance offense.

Also, teens who are cited for controlled substance offenses, even when not driving, may lose the privilege to drive.

(Effective: April 15, 1997) (This section shall become inoperative on June 30, 1999,
and is repealed as of January 1, 2000.)

VEHICLE CODE 13202.5:  USE / LOSE LAW

An adolescent’s driver’s license will be delayed or suspended for one year or more if found in possession or under the influence of alcohol or other substances.

Any person under the age of 21 years, but over the age of 13 years who is found to be in possession and/or under the influence of alcohol or other substances while driving or not driving and is convicted of   

such an offense, shall lose his/her driving privileges for one year. If the person convicted does not yet have the privilege to drive, the issuing of the driving privilege shall be delayed for one year. For each successive offense, the court shall suspend or delay the driving privilege for an additional year. This law applies even if the minor is below the legal blood alcohol level and even if the minor him/herself is not driving. Being under the influence of alcohol or other substances will make the minor suspect to the law.

CODE 25662:  Possession by Person

Under 21 Years of Age

Any minor who possesses alcoholic beverages can be charged with a misdemeanor.

Any person under the age of 21 who has any alcoholic beverage in his or her possession on any street or highway or in any public place or in any place open to the public is guilty of a misdemeanor.

A peace officer who has lawfully entered a premises may seize any alcoholic beverage in plain view which is in possession of, or provided to, a person under the age of 21. If a container holding an alcoholic beverage is open the contents are to be destroyed; if unopened the officer shall impound.

CALIFORNIA LAW PENAL CODE - Section 308b

It is now illegal for persons under the age of 18 years to purchase, receive or possess tobacco, cigarettes or cigarette paraphernalia. The punishment for the first offense is $75 or 30 hours of community service.
